A 31-year-old man whose federal prison sentence was commuted by President Joe Biden earlier this year has been charged with felony firearm possession following an alleged shooting in Omaha, Nebraska.
Khyre Holbert, a convicted felon, was taken into custody on October 4 after police say he was involved in a shooting that left a 28-year-old man hospitalized with non-life-threatening injuries. Authorities say the incident occurred near 13th and Howard streets after officers responded to reports of a disturbance involving a firearm.
According to the Omaha Police Department (OPD), while officers were on the scene, another gunshot was heard, and the wounded victim was discovered nearby. The man was transported to a local hospital for treatment.
Police say Holbert was located shortly afterward in the area of 13th and Farnam streets, matching the suspect description. Officers reportedly recovered a discarded firearm near the scene. Holbert was then taken to OPD Headquarters for questioning.
Following an investigation, Holbert was booked on charges of first-degree assault, use of a weapon to commit a felony, and possession of a firearm by a prohibited person.
Prosecutors on Wednesday formally charged Holbert with felony possession of a firearm. Because the case remains at the complaint stage, additional charges may still be filed. If convicted, Holbert could face up to 15 years in prison.
He is currently being held on bond set at 10 percent of $25,000 and is scheduled to appear in court again on November 17.
The Omaha Police Officers’ Association noted in a social media post that Holbert previously received a 20-year federal prison sentence for guns and narcotics offenses. That sentence was commuted by President Biden on January 17, 2025, during the final days of his administration, reports National Review.
