Chief Justice John Roberts publicly addressed a recently leaked document from inside the Supreme Court this week, calling the publication of a draft opinion on abortion “absolutely appalling.”
“A leak of this stature is absolutely appalling,” Roberts said during his first post-leak appearance at an event in Atlanta. “If the person behind it thinks that it will affect our work, that’s just foolish.”
The Chief Justice confirmed Tuesday that the draft opinion was an authentic document penned by conservative Justice Samuel Alito.
Sen. Ted Cruz (R-TX) guesses the most likely person to have leaked the SCOTUS draft opinion on overturning Roe v. Wade is a law clerk for Sonia Sotomayor, who Cruz calls the "most partisan" justice.

In the draft, Alito claims the Courts should overturn Roe V Wade, sending the issue of abortion back to the individual states as it was prior to 1973.
“Abortion activists have launched a full-throttle campaign against the conservative Supreme Court justices signed on to the leaked document, announcing plans to send protesters to their homes,” reports Fox News.
“The D.C. Police Department has erected fencing around the Supreme Court building in anticipation of escalating protests this weekend. Police have also activated protest-response units through Sunday,” adds Fox.

Is it not the function of The Supreme Court to create laws? If so,isn’t this a question of Roe vs Wade not being law at all?
It is my understanding that Congress votes on and passes laws which then are signed into law by the sitting president.
All the court is suggesting is that this ruling is not, or never was law and should have been thrown out in 1973.
No, the job of the Supreme Court is not to make laws; only Congress has the power to make law. The job of the Supreme Court is to determine, in the event of a challenge to a law, the constitutionality of the law being challenged, nothing more.
No judge, no matter their position, creates laws. That type of behavior is referred to as judicial activism. Generally, judges interpret the laws that Congress and the states pass on behalf of their constituents. The responsibility of the Supreme Court is ensuring the American people equal justice under law and also function as guardian and interpreter of the Constitution.
Create laws? No
They are the final arbiters of laws that are presented to them. Research the duties and responsibilities of our three part government system. Brilliant concept by very smart men in a time when bloodletting was therapy for tuberculosis.
